Terms for Historical Market Data Use in Journalism and Education

These terms govern the limited use of historical market data for journalistic and educational purposes. If you have questions about how these terms apply to your work, please contact us for clarification.

Scope and Definitions

For purposes of these Terms and Conditions (“Terms”) the expression “Historical Data” means stock- and options-market information produced by Market Data (“Provider”) that is at least one full trading day old and is not delivered on a real-time or delayed basis. “User” means any journalist, student, educator, or academic researcher accessing or reproducing Historical Data for non-commercial editorial or educational content (“Permitted Work”). These Terms constitute a limited, non-exclusive, non-transferable, and revocable licence; any use outside the scope described herein is prohibited unless expressly authorised by Provider in writing.

Licence Grant

Provider authorises User to incorporate insubstantial excerpts of Historical Data into Permitted Work solely to illustrate analysis or commentary. The licence extends only to textual or graphical representations contained within the body of the Permitted Work and does not permit separate distribution of the underlying dataset. No sublicensing, onward distribution, or commercial exploitation is permitted.

Attribution and Hyperlink

Each Permitted Work must include a clear and prominent attribution identifying Market Data as the original source of the Historical Data. Attribution must appear in a form reasonably calculated to give notice to the reader that the data originated from Market Data.

In digital formats, this attribution must include a visible, standard do-follow HTML hyperlink pointing directly to https://www.marketdata.app. The hyperlink must not be obscured by redirection, link shortening, cloaking, or any mechanism that conceals the destination URL or inhibits standard indexing.

In print formats, the attribution must appear as the following plain-text citation: “Source: Market Data (https://www.marketdata.app).” The citation must be placed in reasonable proximity to the Historical Data and displayed in a font and size that ensures legibility and visibility to the reader.

Quantity Limitation

Publication of raw Historical Data is limited to no more than one hundred fifty individual data points (each, an “Entry”) per Permitted Work. An Entry is a single record containing one symbol’s price or quote information for a single timestamp. Aggregated statistics, charts, or commentary derived from larger internal datasets are allowed provided they cannot be reverse-engineered to reconstruct the dataset.

Prohibited Conduct

User shall not publish or distribute Historical Data in a downloadable, machine-readable, or database format; include CSV, XLS, JSON, or similar files; expose APIs or searchable interfaces; employ scraping, crawling, or automated extraction technologies; or incorporate Historical Data into software, platforms, or repositories intended for third-party consumption. Any attempt to circumvent technical or contractual access controls constitutes a material breach.

Academic Research Use

User may analyse larger volumes of Historical Data privately for scholarly research. The full dataset underlying such research must remain confidential and may not be uploaded, archived, or otherwise made public, whether as appendices, supplemental files, or institutional repositories, without Provider’s prior written consent. Published findings must comply with the Attribution and Quantity Limitation provisions above.

Warranty Disclaimer and Limitation of Liability

Historical Data is furnished “as is” without warranty of any kind, express or implied, including but not limited to warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. Provider shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or relating to the use of Historical Data, even if advised of the possibility thereof.

Termination and Enforcement

Provider may modify or terminate this licence at any time in its sole discretion. Any breach of these Terms automatically terminates the licence without notice. Provider reserves all legal and equitable remedies, including injunctive relief, damages, and recovery of costs and attorneys’ fees, to address unauthorised use or distribution of Historical Data.

Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the Argentine Republic, without regard to its conflict-of-law principles. User agrees that any dispute, controversy, or claim arising out of or relating to these Terms shall be submitted to the ordinary courts of the City of Buenos Aires, Argentina, which shall have exclusive jurisdiction and venue.

Commercial and Extended Use

Any redistribution, resale, or incorporation of Historical Data into commercial products, services, or platforms requires a separate written agreement with Provider. Licensing enquiries should be directed to [email protected].

Acceptance

By accessing or reproducing any portion of Historical Data, User affirms that they have read, understood, and agreed to be bound by these Terms. Continued use of Historical Data following any modification of these Terms constitutes acceptance of the modified version.
